Country singer Sara Evans filed an amended divorce complaint Monday afternoon in Williamson County that alleges husband Craig Schelske transferred $274,000 from their joint accounts - including $66,500 that had been designated by the couple for church tithing - to an Oregon bank account held in his name only.
Evans' attorneys allege the transfer occurred without her knowledge on Thursday, the same day she filed for divorce in chancery court and a restraining order was granted that prevented such actions.
"He took $207,500 out of a joint checking account and a business account," said John Hollins Jr., who represents Evans with his father, John Hollins Sr. "Those funds were put in the parties' joint tithing account that already had $66,500 in it. Then he liquidated the entire account of $274,000 and transferred it to a U.S. Bank account in Portland (Ore.) in his sole name. This was their tithing account, set up just for church tithes, and he knew that."
The couple, who have not spoken since Thursday's divorce filing, have homes in Franklin and Oregon, and were renting a home in Beverly Hills, Calif., while Evans was a contestant on the ABC show "Dancing With the Stars." They married in 1993, and their children are ages 2, 3 and 7 years old.
Evans, 35, was back in Nashville on Monday, after taping an interview Saturday that will be aired tonight on "Dancing With the Stars." "She did an interview explaining her reasons for withdrawing" from the show, Hollins Jr. said.
Evans' original divorce complaint accused Schelske of committing adultery with the children's former nanny, verbally abusing Evans and frequently watching pornography in their home. It claimed that Schelske had photos of himself having sex with other women, as well as 100 nude photos of himself in an aroused state. In addition, Evans claimed in the filing that he frequently threatened her, "told her she is crazy," and told her he would take the children to Oregon.
In a statement released Friday, Schelske adamantly denied the allegations. "As distressing as it is to have to communicate about this matter publicly, Sara has unfortunately become a dramatically different person over the last year and it is something we have struggled to deal with. Sadly, it appears we have failed."
In response, Hollins Sr. said, "Mr. Schelske is quoted in the press as saying he has done nothing wrong. He has the same information that we have on his computer unless he has destroyed it. The reason Sara Evans filed for a complaint for divorce when she did was to protect her children." .
